"You" means any person who visits the website, creates an account or places an order.

2. Using the website

2.1 You must be 18 years or older or have the consent of a parent or legal guardian, to create an account or place an order.

2.2 You agree to give accurate, current and complete information when registering or ordering, and to keep your account details up to date.

2.3 You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

2.4 You may not use the website for unlawful purposes, attempt to gain unauthorised access to any part of it, interfere with its operation, or place orders you do not intend to pay for.

2.5 We may suspend or close an account, or refuse an order, if these Terms are breached or we suspect fraud or misuse.

3. Products and descriptions

3.1 We sell food, frozen goods, pet food, household items and beverages, among other products. We make every effort to describe and display products accurately, but colours, packaging and presentation may vary from the images shown.

3.2 Product weights, sizes, flavours and brands are shown as supplied by the manufacturer. Suppliers may change packaging or minor specifications without notice.

3.3 Products are offered while stocks last. If an item is out of stock after you order, we will contact you and offer a replacement, a delay until stock arrives, or a full refund for that item.

3.4 Allergen and ingredient information is taken from manufacturer labels. If you have a food allergy or dietary requirement, please check the label on the product you receive. We cannot guarantee that any product is free of allergens.

3.5 Pet food is sold as general nutrition for animals. Nothing on this website is veterinary advice. Please consult a veterinarian about your pet's specific dietary needs.

4. Prices and specials

4.1 All prices are in South African Rand (ZAR). We are not currently VAT registered, so prices do not include VAT.

4.2 Prices and specials can change without notice, but the price you see when you place your order is the price you pay for that order.

4.3 Specials, discounts and promotions are valid while stocks last and for the period stated. They cannot be combined unless we say so.

4.4 If a price is clearly wrong (for example an obvious typing error), we may cancel the order and give you a full refund or give you the option to proceed at the correct price.

5. Ordering and acceptance

5.1 Placing an order is an offer to buy. A contract is formed only when we confirm the order by email or message, or when we dispatch the goods.

5.2 You will receive an order confirmation once your order has been processed. Please check it and tell us immediately if anything is wrong.

5.3 We may decline or cancel an order, for example because of stock issues, pricing errors, an address outside our delivery area, or suspected fraud. If you have already paid, we will refund you in full.

6. Payment

6.1 Payment is made online through our secure payment provider, Yoco, using the methods shown at checkout. Online card payment through Yoco is the only payment option for delivery orders, and we do not accept cash on delivery. Cash is accepted only for orders you collect from us in Lentegeur (Pickup), and is paid on collection. We never see or store your card details. They are handled by the payment provider.

6.2 We do not see or store your full card details. These are handled securely by the payment provider, whose own terms and privacy policy apply to the payment.

6.3 Your order is only processed once payment has been confirmed, except Pickup orders paid in cash, which are paid when you collect them.

6.4 If a payment is reversed, charged back or declined, we may cancel the order.

7. Delivery

7.1 Delivery area. We deliver within Cape Town only, up to 40 km by road from our premises in Lentegeur, Mitchells Plain. If you are further away, please contact us before ordering and we will try to help.

7.2 Delivery fee. Your delivery fee is calculated at checkout, before you pay, at R8 per km by road from our premises at 48 Veronica Street, Lentegeur. The minimum delivery fee is R30. Orders over R1,000 get half-price delivery, but the fee will never be less than R30. If our system cannot find your address on the map, you can still place your order and we will confirm the delivery fee with you afterwards. Collection from our premises in Lentegeur is free (see 7.6).

7.3 Delivery days and times. We deliver Monday to Friday between 10:00-19:00, and on Saturdays between 10:00-15:00. We do not deliver on SUNDAYS AND PUBLIC HOLIDAYS. Delivery times are estimates and are not guaranteed. We will keep you informed of any significant delay.

7.4 Receiving your order. You must give us a complete and correct delivery address and a contact number, and someone must be available to receive the order. If no one is available, we will try to contact you on the number you provided. If we still cannot hand over the order, we may either (a) redeliver on the next available delivery day, which may carry an additional delivery fee, or (b) cancel the order and refund you the price of the goods, less the delivery fee and any reasonable costs we have incurred. Frozen and perishable goods that cannot safely be delivered may be cancelled in this way. We are not responsible for failed or delayed delivery caused by incorrect or incomplete details.

7.5 Risk and ownership. Risk in the goods passes to you when they are delivered to you or to the person at the address you provided. Ownership passes to you once we have received full payment.

7.6 Collection. Where available, you may collect your order from our premises at 48 Veronica Street, Lentegeur, Mitchells Plain, Cape Town, during our trading hours (Monday to Friday 09:00-17:00, Saturday 09:00-15:00). Collection is by arrangement only: please collect only after we have confirmed that your order is ready and bring your order number and some form of identification.

8. Frozen, chilled and perishable goods

8.1 Frozen and perishable products (including ice cream, frozen desserts, frozen fish and raw pet food) must be stored correctly. Please unpack and refrigerate or freeze them immediately on delivery.

8.2 Please inspect these items when you receive them. If a frozen item has thawed, or a perishable item is damaged, incorrect or visibly not fit for consumption, tell us on the day of delivery, and in any event within 24 hours of delivery, with your order number and a clear photo of the product and packaging. Problems that could not reasonably be seen on delivery (for example spoilage before the expiry date) must be reported as soon as you discover them. This does not limit your rights under the Consumer Protection Act.

8.3 We cannot accept responsibility for products that have been left unattended after delivery, stored incorrectly, refrozen after thawing, or kept beyond the "best before" or "use by" date.

8.4 Raw pet food may contain bacteria. Wash your hands and any surfaces or bowls after handling and keep it away from other food and young children.

9. Returns, exchanges and refunds

9.1 Your rights under the law. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). If anything in these Terms conflicts with those Acts, the Acts apply.

9.2 Faulty, damaged, unsafe or incorrect goods. If an item arrives damaged, defective, expired, unsafe or different from what you ordered, contact us as soon as possible with your order number and a photo. For defective or unsafe goods, you may within 6 months of delivery ask us to repair, replace or refund the item, as provided in the CPA. If goods are not as described or ordered, you may reject them and receive a full refund if you tell us within 10 business days of delivery. We will arrange collection of the item, or ask you to keep or dispose of it, depending on the circumstances.

9.3 Perishable and everyday consumption goods. Under section 42 of ECTA, the 7-day cooling-off right for online purchases does not apply to foodstuffs, beverages and other goods intended for everyday consumption delivered to your home or workplace. Because most of our products fall into this category, and for food safety reasons, we generally cannot accept returns of food, frozen goods, beverages, pet food or other consumables simply because you changed your mind. This does not affect your rights in clause 9.2.

9.4 Non-perishable items (change of mind). For non-perishable items that are unopened, unused, sealed, in original packaging and in resaleable condition, we will, as a goodwill option, accept a return for a refund or exchange if you contact us within 7 days of delivery. You carry the cost of returning the item unless the return is due to our error or a fault. This clause does not apply to food, frozen goods, beverages, pet food or other consumables.

9.5 Refunds. Approved refunds are paid to the original payment method within 10 business days of approval, and in any event within the periods required by law (generally no later than 15 business days after we receive the returned goods or your cancellation notice, and no later than 30 days where ECTA applies). Delivery fees are refundable only where we made an error or could not deliver. Your bank or payment provider may take additional time to process the refund. You may ask for a refund in money rather than a voucher or store credit.

9.6 Cancelling an order. You may cancel an order before it is dispatched by contacting us as soon as possible. Once an order is out for delivery, it can no longer be cancelled, subject to your legal rights.

9.7 Missing or incorrect items. Please check your order on delivery and report anything missing or incorrect within 24 hours of delivery. For goods that are not as described or ordered, your right to reject them and receive a refund within 10 business days (clause 9.2) is not affected.

10. Warranties and limitation of liability

10.1 We supply products as sourced from reputable manufacturers and suppliers, and we take reasonable care in storing and delivering them.

10.2 To the extent allowed by law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your misuse or incorrect storage of products, or from events outside our reasonable control (for example load-shedding, strikes, severe weather, road closures, supplier failure or interruptions to internet or payment services).

10.3 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for gross negligence, or your rights under the CPA.

10.4 The website is provided "as is". We do not guarantee that it will always be available, uninterrupted or error-free.

11. Privacy and your personal information (POPIA)

11.1 We process your personal information in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Our Privacy Policy, available on this website, explains what we collect and why, and forms part of these Terms.

11.2 In summary, we collect the information you give us (such as your name, contact details, delivery address and order history) to create your account, process and deliver orders, take payment through our payment provider, communicate with you about your orders, prevent fraud, and comply with the law.

11.3 We share your information only with those who need it to serve you, such as delivery drivers and our payment provider, or where the law requires it. We do not sell your information.

11.4 You may ask to see, correct or delete your personal information by contacting us at admin@mrbowmanstrading.co.za. If you have a complaint, you may also contact the Information Regulator.

11.5 We will send you marketing messages only if you have agreed to receive them, and you can opt out at any time.

12. Intellectual property

12.1 All content on this website, including logos, text, images and design, belongs to us or our licensors and may not be copied, reproduced or used without our written permission.

12.2 Product names, logos and brands belong to their respective owners and are used for identification only.

13. Reviews and communications

13.1 If you post a review or message on the website, you confirm that it is truthful and lawful, and you grant us a non-exclusive right to display it. We may remove content that is offensive, false or unlawful.

13.2 By providing your contact details, you agree that we may contact you about your orders by email, SMS or WhatsApp.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this website with a new "last updated" date. Your continued use of the website or placing of an order after changes means you accept them. Orders you have already placed are governed by the Terms in force when you placed them.

15. Complaints and dispute resolution

15.1 If you are unhappy with a product or our service, please contact us first at admin@mrbowmanstrading.co.za so we can try to resolve it.

15.2 If we cannot resolve it, you may refer the matter to the National Consumer Commission, the Consumer Goods and Services Ombud, or any other body or court with authority under South African law.

16. General

16.1 These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

16.2 If any part of these Terms is found to be invalid or unenforceable, the rest remains in force.

16.3 Our failure to enforce any right is not a waiver of that right.

16.4 These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the website and purchases from it.

16.5 For the purposes of any legal notice, we choose as our address the registered office shown in clause 1.
